By installing or using the App, you agree to these Terms and to our [[Notices/Privacy|Privacy Policy]]. If you do not agree, do not use the App. ## 1. What Phlip is Phlip is a **self-hosted** event-planning and group-chat app. One user (the "**Host**") runs the server on their own Android device; other users ("**Members**", and unregistered "**Guests**" who open Broadcast links) connect to that Host. **We operate no servers and store no user content.** Groups, their data, and their moderation are controlled by the Host, not by us. ## 2. Eligibility and minimum age - You must be at least **13 years old** to use the App at all. Individual servers may set a higher minimum age, shown before you join. - You must be at least **18 years old** to act as a **Host**, because hosting carries operator and data-protection responsibilities for other people (see Section 5). - By using the App you confirm you meet the applicable age requirement. If you are under the age of majority where you live but old enough to use the App, you confirm a parent or guardian has reviewed and agreed to these Terms. - The App is **not** directed to children under 13. ## 3. Licence Phlip is **proprietary software**. It is not open source and is not licensed under the Apache License 2.0 or any other open-source licence. See the [[Notices/Licence|Phlip Proprietary Software Licence]]. For your use of the compiled App distributed through an authorised channel (for example an app store), we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you control, subject to these Terms, our Privacy Policy, and the applicable app-store terms (Google Play, Apple App Store). You may not copy, modify, redistribute, reverse engineer (except where mandatory law requires), or use the App for any unlawful purpose, except as these Terms expressly allow (including normal Host / Member use of a self-hosted server). ## 4. Acceptable use You agree that you will **not**, and will not allow others in your group to: - post, share, or transmit content that is illegal, that infringes others' rights, or that is harassing, hateful, threatening, or sexually exploitative. In particular, **any content that sexualises minors is strictly prohibited and will be reported to authorities where required**; - use the App to harass, stalk, dox, impersonate, or harm any person; - upload malware, attempt to breach security, disrupt the service, or circumvent access controls or age gates; - infringe intellectual-property or privacy rights, or share others' personal data without a lawful basis; - use the App to send spam or for any unlawful surveillance; - use public Broadcast links to expose third parties' personal information without their consent; - use the App to impersonate legitimate entities or people. We may make the App or updates unavailable, or take store-level action, in response to serious or systemic abuse. Because the App is self-hosted, **day-to-day moderation is performed by the Host** (see Sections 5 and 7); we do not monitor group content and generally cannot access it. ## 5. Host responsibilities ("Host regulations") If you choose to run a group as a **Host**, you take on additional responsibilities. By hosting, you agree that: 1. **You are the operator of your server.** You are responsible for your device, the group data stored on it, who you admit, and everything that happens on the servers you run. 2. **You are the data controller** for your group's personal data (member names, avatars, message metadata, and any content members share). You are responsible for complying with the data-protection and privacy laws that apply to you and your members (which may include the UK GDPR, EU GDPR, CCPA, or others). 3. **You must have a lawful basis** to collect and store members' data, and you must handle members' requests to access, correct, delete, or export their data — including removing a member's stored record when they ask you to or when you remove them. 4. **You are 18 or older** and legally able to accept these responsibilities. 5. **You are responsible for content and moderation** in your group. You must act on reports of abuse using the tools the App provides (approve/deny joins, roles, remove members, remove content, block, revoke Broadcast links) and, where applicable, act on objectionable-content reports promptly. You must remove content and eject users that violate Section 4. 6. **Public hosting and Cloudflare.** If you make your group publicly reachable, traffic is relayed through Cloudflare, and you agree to Cloudflare's applicable terms of service. You are responsible for understanding that some data (see the Privacy Policy) is not encrypted in transit. 7. **You will not host** content or activity prohibited by Section 4, and you will comply with all laws that apply to operating a service for your members. 8. **Indemnity.** To the extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your operation of a server, your handling of members' data, or content on servers you host. We provide Hosts with tooling but are **not** a party to the relationship between a Host and their Members and are not responsible for a Host's conduct or a Host's device. ## 6. Your content You retain ownership of content you create. Because Phlip is self-hosted and content is end-to-end encrypted where indicated, we do not claim any licence to your content and do not access it. You are responsible for the content you post and for having the rights to share it. ## 7. Reporting and moderation The App provides means to report content or users to the Host of the relevant group, and to block other members. Where a Host is themselves the problem, you can reach us through the in-app **Contact & Bug Report** option or the support address on our store listing. We can review reports about the App and take store-level or software-level action, but because we do not host or store group data, we generally cannot remove specific content from a Host's device. Hosts are responsible for acting on reports within their groups. ## 8. Purchases (Supporter) Optional in-app **Supporter** purchases unlock **cosmetic items only** and never gate features or remove anyone else's access. Purchases are processed by Google Play and are subject to Google Play's terms and refund policies. Cosmetic entitlements are non-transferable. ## 9. Disclaimers — the App is provided "AS IS" TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED **"AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND**, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, security, availability, or that the App will be uninterrupted or error-free. We do not warrant that encryption or any security feature is complete or will prevent all unauthorised access. You use the App, and host groups, **at your own risk**. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you. ## 10. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR CONTRIBUTORS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY ACT OF A HOST OR ANOTHER USER, ANY DATA EXPOSURE, OR ANY THIRD-PARTY SERVICE (INCLUDING CLOUDFLARE). OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) **[liability-cap figure — e.g. GBP 50 / USD 50]**. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. ## 11. Third-party services and software The App relies on and includes third-party software and services (including Cloudflare, and open-source components such as NanoHTTPD, OkHttp, Gson, and AndroidX/Material). Their use is subject to their own terms and licences; see the **Third-party notices** provided with the App. We are not responsible for third-party services. ## 12. Termination You may stop using the App at any time and uninstall it. We may suspend or terminate your licence if you materially breach these Terms. Sections that by their nature should survive (including Sections 5.8, 9, 10, and 13) survive termination. ## 13. Governing law and disputes These Terms are governed by the laws of **[JURISDICTION — e.g. England and Wales]**, without regard to conflict-of-laws rules, and disputes will be subject to the courts of **[JURISDICTION]**, unless mandatory local consumer-protection law gives you other rights. ## 14. Changes to these Terms We may update these Terms. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by notice in the App. Continued use after changes take effect means you accept the updated Terms. ## 15.
